1. About these terms
These terms apply to use of the AktivateHub website and services. By creating an account, submitting a request, listing a business, or using the site, these terms are accepted.
2. What AktivateHub is
AktivateHub is an online platform that lets consumers find vendors and lets vendors receive inquiries and leads. AktivateHub is not a party to any contract between a consumer and a vendor. Vendors set their own prices, schedules, and service terms. Consumers and vendors contract directly and are responsible for their choices. Consumer protections under NZ law continue to apply to any services purchased.
3. Accounts
Accurate information must be provided and kept current. Account credentials must be kept secure. Activity under an account is the account holder’s responsibility. AktivateHub may suspend or terminate accounts for policy breaches, fraud risk, or unlawful activity.
4. Vendor listings and leads
Vendors may create profiles and receive consumer requests that match their categories and locations. AktivateHub does not guarantee a number of leads, conversion, or revenue. AktivateHub may rank, feature, or moderate listings to keep quality high.
5. Reviews and content
Users may post reviews and content that reflect genuine experiences. Content must be lawful, respectful, and not misleading. By posting content, a non-exclusive, worldwide licence to host, display, and use that content on the platform is granted. Content may be edited or removed if it breaches these terms or applicable law.
6. Acceptable use
The service must not be used to:
break the law or infringe rights;
mislead, spam, or harass others;
upload malware or attempt unauthorised access;
scrape the site or resell access without permission.
Compliance with NZ Fair Trading Act obligations (no misleading or deceptive conduct) is required for traders.
7. Fees and payments (vendors)
Plan fees, lead fees, or commissions (if any) will be shown at checkout or in the vendor dashboard or email will be sent to the vendor. Prices may change with notice. Taxes are the vendor’s responsibility unless stated otherwise. Payment processing is provided by third-party providers under their terms.
8. Quotes, bookings, and cancellations
Quotes provided through the platform are not controlled by us. Availability, changes, and cancellations are handled by the vendor’s own terms and by applicable consumer law. Aktivatehub is not responsible for any incorrect information shared in the quote by any vendor. Consumers should confirm inclusions, timing, and any additional charges before booking. The Consumer Guarantees Act may apply to services acquired for personal use.
9. Messaging and notifications
Messages and notifications may be sent to facilitate matches and manage enquiries. Commercial electronic messages include accurate sender details and a simple unsubscribe where required.
10. Privacy
The Privacy Policy forms part of these terms.
11. Intellectual property
All site content, trademarks, logos, and software are owned by AktivateHub or licensors. They may not be copied, modified, or distributed without permission, except where the law allows.
12. Availability and changes
The service may change or be unavailable due to maintenance or events outside control. Features may be added or removed. Material changes will be notified where reasonable.
13. Disclaimers
The platform is provided “as is”. Marketplace matching is facilitated, but the quality, safety, legality, and performance of vendor services are not guaranteed by AktivateHub. To the fullest extent permitted by law, implied warranties are excluded. Nothing limits rights that cannot be excluded under the Consumer Guarantees Act where it applies.
14. Liability
To the extent permitted by law, AktivateHub is not liable for lost profits, lost business, loss of data, or indirect or consequential loss. Where liability cannot be excluded, it is limited to the greater of the amount paid to AktivateHub in the 12 months before the claim or NZD 100, unless the law requires otherwise.
15. Indemnity
Vendors and users agree to indemnify AktivateHub against claims, losses, and costs arising from their content, conduct, or breach of these terms or law.
16. Electronic contracting
Electronic records, clicks, and signatures may be used to enter agreements with us and between users, as allowed by NZ law (now consolidated in the Contract and Commercial Law Act 2017).
17. Governing law and disputes
These terms are governed by New Zealand law. The courts of New Zealand have non-exclusive jurisdiction. Consumers may also access any mandatory protections available in their place of residence where applicable.
